We assist in the evolution of medical device companies throughout their R&D lifecycle, as well as deal with more mature products with proven track records of success in the market (and in court). In all cases, we make sure that patent decisions form part of an overall business strategy. For example, we guide decision makers within medical device companies to consider how widely the company intends to make or distribute its own devices, rather than licensing those rights to others. We ask them to consider the estimated life expectancy of a medical device, since a device that has an expected short product life expectancy may expire before the patent is even issued, whereas devices with longer life spans may justify a larger patent budget. Another factor to consider is fund raising, since ownership of patents may enhance the ability to attract venture capitalists and raise the capital necessary to take a product to market.
We engage in a thorough due diligence process in regards to the technology of our clients and comment on its applicability as a candidate for technology development over the next few years. We conduct patent searches in the professional directories to determine whether the technology is innovative and inventive, and we lead our clients through the full process of bringing a patent to confirmation and litigation, if necessary. Up until today, we have succeeded in court due to our aggressive approach and generally compromise on a more narrow defense than that requested by the client in order to ensure success.
